Terms of Service

1. Introduction and Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the services provided by Maple Paws Pet Care (“Maple Paws,” “we,” “us,” or “our”), including our website, booking channels, communications, and in-person pet care services.

By booking, purchasing, scheduling, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, you must not use our services. These Terms form a legally binding agreement between you and Maple Paws Pet Care.

You represent and warrant that you are at least the age of majority in your province or territory of residence, or that you have the consent of a parent or legal guardian to use our services and enter into these Terms.

2. Scope of Services

Maple Paws Pet Care provides pet-related services, which may include, without limitation:

  • Dog walking
  • Pet grooming
  • Cat sitting
  • Pet daycare
  • Basic pet training
  • Overnight pet care

The exact scope, duration, frequency, location, pricing, and special instructions for services will be confirmed at the time of booking or in a written service agreement, intake form, or invoice. We reserve the right to refuse, suspend, or discontinue services where we determine, in our reasonable discretion, that a pet, client, environment, or request presents a safety, legal, health, or operational concern.

Our services are not veterinary services and do not replace professional veterinary care, diagnosis, or treatment. We do not provide emergency medical services. In the event of an emergency, we may seek veterinary assistance as described in these Terms.

3. User Obligations and Responsibilities

You agree to provide complete, accurate, and current information about yourself, your pet(s), and any relevant circumstances, including:

  • Pet name, breed, age, sex, temperament, and medical history
  • Vaccination status and parasite prevention information
  • Known allergies, behavioural concerns, triggers, aggression, anxiety, or escape tendencies
  • Feeding instructions, medication requirements, and emergency contact details
  • Any special handling instructions or restrictions

You further agree to:

  • Ensure your pet is fit to receive the requested services and is free from contagious illness, parasites, or conditions that may endanger others, unless disclosed and accepted by us in writing;
  • Maintain all required vaccinations, licenses, and identification tags as required by applicable law;
  • Provide safe access to your property or pet location, including keys, codes, or other access methods when necessary;
  • Securely restrain or contain your pet as appropriate before and after service visits;
  • Disclose any history of biting, aggression, or other dangerous behaviour;
  • Ensure that all equipment, leashes, collars, harnesses, crates, and supplies provided by you are safe and suitable for use;
  • Promptly notify us of any changes to your contact information, emergency contacts, or pet condition;
  • Comply with all applicable municipal, provincial, and federal laws, including animal welfare and public safety laws.

You acknowledge that failure to provide accurate information or to meet these obligations may result in service refusal, suspension, additional charges, or termination of services without refund where appropriate.

4. Payment Terms and Conditions

Fees for services will be communicated at the time of booking, in a quote, price list, invoice, or service agreement. Unless otherwise stated, all prices are in Canadian dollars (CAD) and are subject to applicable taxes, including GST/HST where required by law.

Payment terms may include one or more of the following:

  • Advance payment or deposit requirements for bookings;
  • Payment upon completion of services;
  • Recurring billing for ongoing services;
  • Additional charges for late pickups, extended visits, special handling, travel, supplies, or emergency care coordination.

You authorize us, or our payment processor, to charge the payment method provided for all agreed fees, taxes, and approved additional charges. If a payment is declined, reversed, or otherwise not completed, you remain responsible for the full amount due and any reasonable costs incurred in collection, to the extent permitted by law.

We may adjust our pricing from time to time. Updated pricing will apply to future bookings and, where applicable, to recurring services after reasonable notice.

If a pet requires emergency veterinary care, you authorize us to seek such care and agree to reimburse all related costs, including transportation, treatment, medication, and administrative expenses, unless prohibited by law.

5. Cancellation and Refund Policy

Cancellations and rescheduling requests must be made in accordance with the notice period communicated at booking or in our service policies. If no specific notice period is stated, the following general policy applies:

  • More than 48 hours before the scheduled service: no cancellation fee, subject to any non-refundable deposit;
  • 24 to 48 hours before the scheduled service: a cancellation fee may apply;
  • Less than 24 hours before the scheduled service or failure to provide access: the full service fee may be charged.

Deposits, booking fees, and prepaid packages may be non-refundable unless otherwise required by applicable consumer protection law or expressly stated otherwise in writing. Refunds, if any, will be issued at our discretion in accordance with applicable law and the circumstances of the cancellation.

We reserve the right to cancel or reschedule services due to safety concerns, severe weather, illness, emergency, non-payment, inaccurate information, or other reasonable operational reasons. Where we cancel a service for reasons within our control, we will generally offer a reschedule or refund for the unused portion, as appropriate and required by law.

6. Liability Limitations

To the fullest extent permitted by applicable law, Maple Paws Pet Care, its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of business, emotional distress, or loss of data, arising out of or related to the use of our services.

While we take reasonable care in providing services, you acknowledge that pet care involves inherent risks, including but not limited to injury, illness, escape, property damage, allergic reactions, behavioural incidents, and accidents. You assume all risks associated with your pet’s participation in our services, except to the extent caused by our gross negligence, wilful misconduct, or as otherwise prohibited by law.

Our total aggregate liability for any claim arising out of or relating to the services shall be limited to the amount paid by you for the specific service giving rise to the claim, except where such limitation is not permitted by law.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence where such exclusion is prohibited, or any statutory rights that cannot be waived.

You agree to indemnify, defend, and hold harmless Maple Paws Pet Care from and against claims, losses, liabilities, damages, costs, and expenses arising from: (a) your breach of these Terms; (b) inaccurate or incomplete information provided by you; (c) your pet’s behaviour, illness, or injury not caused by our gross negligence or wilful misconduct; or (d) your violation of any law or third-party rights.

7. Intellectual Property Rights

All content, branding, logos, text, graphics, photographs, service descriptions, designs, and other materials provided by Maple Paws Pet Care are owned by us or our licensors and are protected by applicable intellectual property laws in Canada and elsewhere.

You may not copy, reproduce, modify, distribute, display, publish, transmit, or create derivative works from our intellectual property without our prior written consent, except as permitted by law.

Any feedback, suggestions, or ideas you provide to us may be used by us without restriction or compensation, unless otherwise agreed in writing.

8. Data Protection and Privacy

We collect, use, disclose, and retain personal information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and any applicable provincial privacy legislation.

We may collect personal information such as:

  • Your name, address, phone number, and email address;
  • Pet information and service preferences;
  • Billing and payment information;
  • Emergency contact details;
  • Communications and service records;
  • Information necessary to provide, manage, and improve our services.

We use personal information to provide services, process payments, communicate with you, maintain records, comply with legal obligations, and protect the safety of pets, clients, staff, and the public.

We may share personal information with third-party service providers, such as payment processors, scheduling tools, or veterinary professionals in an emergency, only as reasonably necessary to deliver services or comply with law.

By using our services, you consent to our collection, use, and disclosure of personal information as described in these Terms and in any separate privacy policy we may provide. Where required by law, we will obtain additional consent.

You are responsible for ensuring that any personal information you provide about third parties, including emergency contacts, is shared lawfully and with appropriate consent.

9. Force Majeure

We shall not be liable for any delay, failure, or interruption in performing our obligations due to events beyond our reasonable control, including but not limited to extreme weather, natural disasters, fire, flood, power outages, labour disputes, transportation disruptions, public health emergencies, government actions, acts of war, terrorism, civil unrest, or internet or telecommunications failures.

In such circumstances, we may suspend, reschedule, or modify services without liability, except to the extent otherwise required by applicable law. Where feasible, we will make reasonable efforts to notify you and arrange an alternative service date or other appropriate solution.

10. Changes to Terms

We may update or modify these Terms from time to time to reflect changes in our services, business practices, or applicable law. The revised Terms will be effective upon posting or upon the date stated in the notice, whichever is later.

Your continued use of our services after the effective date of any updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using our services.

11. Applicable Law and Jurisdiction

These Terms and any dispute arising out of or relating to them, our services, or any related matter shall be governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of laws principles.

You agree that the courts located in Toronto, Ontario shall have exclusive jurisdiction over any dispute, claim, or proceeding arising from or related to these Terms or our services, except where applicable law requires otherwise.

13. Severability Clause

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed or limited to the minimum extent necessary so that the remaining provisions continue in full force and effect to the fullest extent permitted by law.

No waiver of any provision of these Terms shall be effective unless in writing, and any failure by us to enforce a right or provision shall not constitute a waiver of such right or provision.

These Terms constitute the entire agreement between you and Maple Paws Pet Care regarding the subject matter herein and supersede any prior or contemporaneous understandings, communications, or agreements, whether oral or written, to the extent permitted by law.
